Okmulgee County Tribal Court Jurisdiction

Okmulgee County is unique because the city of Okmulgee serves as the capital of the Muscogee (Creek) Nation. After the McGirt v. Oklahoma Supreme Court ruling, tribal jurisdiction plays a large role in criminal cases here. Crimes involving Native American defendants or victims on tribal land may fall under Creek Nation or federal jurisdiction instead of the state court.

This means some criminal cases that would normally be in the Okmulgee County District Court are now handled by the Creek Nation District Court or by federal prosecutors in the Eastern District of Oklahoma. If you are looking for a specific case and cannot find it on OSCN, it may be in the tribal or federal system instead. Creek Nation court records are not on OSCN. Federal cases can be searched through PACER.
